Payment Facilitators provide numerous services for sub-merchants; how to provide settlement services without triggering Federal or state money transmission laws. Many payment facilitators provide settlement services and rely on "FBO" accounts to protect themselves from regulatory enforcement. We will discuss the controls that should be in place (and the various requirements of) the state money transmitters to avoid inadvertent regulatory scrutiny.
